MAIN JOB DUTIES/RESPONSIBILITIES(the most important duties):
Compliance prioritization and enhancement of the dealers (distributors) and the dealer management structure:
· Upgrade the existing dealer management program.
· Liaise with current DMS administrator (Phebe)
· Drive direct + effective compliance training to dealers across china
· Optimize business model & business flow, and reduce the MDT compliance risk footprint
· Assist in the review of 'platform dealers' (eg: Cardinal or DKSH)
· Work with dealer management team to enhance due diligence procedure for opening, renewals and/or consolidation and/or termination of dealers;
· Specify compliance rules and requirements on dealer's behavior for their performance of the contracts;
· Conduct dealer monitoring in terms of compliance of FCPA.
· Work with internal audit for a FY14 audit schedule
· Ensure that all MDT transactions with dealers are free from FCPA risks;
And for BCS (Business Conduct Standards) management:
· Review payments/benefits to customers to ensure the compliance with related China laws/regulations, Medtronic Code of Conduct, Business Conduct Standards and US FCPA;
· Provide advice and training on compliance laws, regulations and company policies;
· Conduct periodically internal monitoring and auditing, as well as follow up of findings;
· Proceed investigation when potential violations are detected;
· Keep close coordination with global compliance team;
· Keep pro-active communication with concerned business unites and cooperate with other functional departments;
· Review, set up, update and implement compliance procedures and policies;
· Coordinate with government agency or other organization on any enquiry, investigation and audit regarding compliance.
· Involve in specific project as delegated by Chief Counsel.
Experience and Knowledge:
· At least six years experience in a paralegal or Legal Clerk role or in at least 3rd year of a law degree.
· Experience in a healthcare environment highly desirable (...but not absolutely essential).
· Experience in a legal compliance role highly desirable
· Previous document management experience will be highly regarded, however, not essential.
· Computer literacy including sound knowledge of the MS Office suite of software.
· Proven evidence of Medtronic Core Behaviors.
Qualifications:
· Completed law degree is highly desirable.
Other Comments or Requirements:
· Some domestic and overseas travel at short notice may be required.
· Some out of hours and on-call work may be required
