职位描述

A well-known European pharmaceutical company is looking for an experienced compliance officer with a strong desire to apply his/her skills to their fast growing business in China. The major responsibility of the role is to support Senior Manager in leading or conducting ongoing monitoring of high risk areas, audit of key compliance risks and conduct assigned case investigations in an objective, consistent and timely way, ultimately ensuring the organization compliance with global and local policies, relevant local and international laws and prompt detection and reporting of any major breaches identified. The role is also providing assurance and oversight of the compliance risks in the daily business operations.

Authorities To deliver on these accountabilities, the Compliance Officer must have the following authorities:

? Governance – has the authority to develop and recommend new procedures and processes at branch level to govern regulatory and compliance risk.
? Advisory - has the authority to provide advice and counsel to his/her colleagues on regulatory requirements, industry best practices.
? Recommending - has authority to recommend policies, procedures and standards for compliance with regulatory requirements for HK Branch.
? Coordinating - has the authority to coordinate work and/or call people together to discuss/resolve regulatory and compliance issues. Can persuade people to change course and/or act in concert with each other as is appropriate to a given situation.
? Monitoring - has the authority to collect or be provided with the required information from systems or other employees or members of management when reviewing and reporting on supervisory controls, regulatory requirements, compliance with policies and procedures and effectiveness of HK Compliance Program.
? Auditing - has the authority to examine the work of others to ensure compliance with all regulatory requirements at branch level.
? Investigative – has the authority to review branch’s transactions, agreements, documentation and decide whether to approve them or not. Has the authority to recommend to management to cease activities/documents outside the company and/or local branch standards.
? Escalating – has the authority to escalate issues to branch management, company management or Head of Compliance, when required.

Accountabilities (List with approximate percentages)

? 20% Risk Assessment: Supports compliance risk and control assessments through inputs and intelligence obtained through monitoring, audit and investigations and other sources including external and industry intelligence.
? 30% Compliance Monitoring: establish, document and maintain Compliance monitoring and controls to minimize risk and support compliance with relevant laws and legislation. Oversee the review, interpretation, and dissemination of current and proposed laws and regulations, code of conduct and ethics and industry best practices.
? 20% Training: establish training courses for all staff on code of ethics and conduct; regulatory requirements and updates; industry best practices and compliance related matters.
? 20% Investigation: Efficiently lead and manage the compliance investigations, including whistle blowing cases, ensuring the investigations are carried out fairly, objectively, timely, thoroughly and in accordance with Global Investigations Policy, Code of Conduct and Chinese Labor Law; Along the process, ensure relevant stakeholders are kept informed on need to know basis and ensuring prompt and accurate updates of relevant global system tracking incidents and investigations.
? 10% Compliance Reporting: report any compliance issues, deficiencies, etc. and remedial recommendations to Management and for tracking these through to completion.


Knowledge and Skills

? 6+ years working experience in audit & fraud prevention and detection area, such as Forensics Investigations, Compliance, Audit, Legal or consulting roles in MNCs or Big 4 Firms.
? Experience in implementing any of the following: compliance, legal or regulatory programs within a business preferred. This experience should include progressive responsibility.
? Highly ethical and objective
? Sound knowledge in anti-corruption and anti-bribery
? Strong independence, proactive and result orientated
? Good analytical skills and solid knowledge in assurance & validation area, including collecting and analyzing data, evaluating information and systems, and drawing logical conclusions
? Strong collaboration skills, being able to work with all levels of staff across the organization
? Excellent communication, influencing and interpersonal skills, good ability to frame issues and communicate complex issues in concise terms
? Maturity to tackle and manage conflicts, being resilient under high pressure
? Inquisitive (healthy skepticism); eye for detail yet have good broad perspectives.
? Being logical with good sensitivity
? Having the ability to resolve complex and routine problems
? Passionate in supporting the organization’s vision to win the right way.
