职位描述

1. Experience / Knowledge
? Understanding of contracts and contract law
? Understanding of the law in China
? Experience in contract administration
? Minimum 7 years experience in the construction industry in Asia

2. Education / Qualifications
? Engineering degree or equivalent
? Member of RICS or equivalent Institution

3. Technical Skills
? Familiar with Autocad and has knowledge of Microsoft office

4. Language
? Fluent in English – spoken & written

5. Other Requirements
? Willing to travel within East China and North China


Job Responsibilities / Essential Function

? Drafting, evaluation, negotiation and execution of contracts including principle, inter- and sub- contracts
? Serve as the point of contact for Clients on contractual matters. Act as contractual “middleman” between Company employees and Clients/MCs/Consultants, ensuring timely review and approval / reconciliation of variations and/or delay notifications.
? On all standard and non-standard contracts, provide redlined recommendations and often negotiate directly with the Client / MC until consensus has been reached.
? Ensure that we maintain contractual records and documentation, such as receipt and control of all contract correspondence, Client contact information sheets, contract summary sheets, contractual changes, Design Change Notices, TCM allocation sheets, status reports and other documents for all projects.
? Ensure that proposed bond and guarantee formats meet Company Policy and highlight risks when such formats are outside the necessary parameters.
? As needed, provide guidance on contract matters to Project Managers, including training to new Project Managers, commercial staff and other employees in contracting procedures.
? Develop and implement procedures for Contract Management and administration in compliance with Company policy. As appropriate, contribute to or influence or recommend change to Company policies through Regional Management.
? Monitor compliance of the Project Team, and specifically the Commercial Department, with established procedures.
? Work with the Regional Management to coordinate contractual insurance requirements general or specific to projects.
? Work with Finance Department to ensure adherence to broader finance and risk requirements such as budget establishment and reviews, revenue recognition, pricing and discounting policies, cashflow establishment and reviews, value management and so on.
? Support the Tendering Department as required to ensure Company products and services are offered with appropriate, competitive terms, conditions and qualifications, and further to review contract documents.
? Work closely with the Project Teams and apply experience and recommendations to suit the circumstances; assist and direct the Project Manager as necessary with regards to contractual, commercial and project related issues.
? Monitor competitive terms and conditions within internally generated agreements including sub-contracts, works orders, inter-company agreements and purchase orders. Monitor client/ sub-contractor/ supplier satisfaction with our terms and conditions and contracting practices. Recommend changes as applicable.
? Ensure that signed contracts are communicated to all relevant parties to provide contract visibility and awareness, interpretation to support implementation. Ensure that the risks are highlighted to the Project Director / Manager and the General Manager.
? Handle on-going issues and change management; assist in the preparation of major claims for additional monies and/or extension of time.
? Monitor contract administration compliance (milestones, deliverables, payment application and so on.)
? Oversee the commercial teams assigned to the projects. Monitor project specific CPRs, working budgets, cashflow forecasts, claims registers, notifications and so on.
? Ensure contract close-out (Final Account) and prompt collection of outstanding monies, attending meetings with the Client / MC as appropriate.
? Advise on dispute resolution and legal issues that may arise during the course of a project.
